These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services provided by Gold Standard Web (“Gold Standard Web,” “we,” “us,” or “our”), including Ryzor (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
1 Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Services. When you create an account, you agree to provide accurate information and to keep it current. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
2 The Services
The Services allow you to generate, customize, manage, and publish websites and related materials. We may add, change, or discontinue features from time to time. We aim to keep the Services available and reliable, but we do not guarantee that they will be uninterrupted or error-free.
3 Subscriptions, fees & billing
- Certain Services are offered on a paid subscription basis. By subscribing, you authorize us and our payment processor to charge the applicable fees to your payment method.
- Unless stated otherwise, subscriptions renew automatically at the end of each billing period until canceled.
- You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law or expressly stated by us.
- We may change our prices; we will give reasonable notice before a price change affects you.
- Plan limits (such as the number of sites you may generate) apply as described at the time of purchase.
Payments are processed by Stripe, Inc. and are subject to Stripe’s terms in addition to these Terms.
4 Your content & ownership
You retain ownership of the content you submit and, subject to these Terms and payment of applicable fees, of the websites and outputs you generate using the Services (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Services. You are responsible for Your Content and represent that you have the rights necessary to use it and that it does not infringe the rights of others or violate any law.
5 Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, deceptive, or infringing purpose;
- Upload malware or attempt to disrupt, probe, or gain unauthorized access to the Services or related systems;
- Reverse engineer, resell, or copy the Services except as expressly permitted (for example, under a white-label plan we offer);
- Use the Services to generate content that is illegal, hateful, harassing, or that violates the rights or privacy of others; or
- Misrepresent your identity or your affiliation with any person or entity.
We may suspend or terminate access for violations of these Terms.
6 Intellectual property
The Services, including their software, design, and branding (such as the Gold Standard Web and Ryzor names and logos), are owned by Gold Standard Web and protected by law. Except for the rights expressly granted to you, we reserve all rights in the Services.
7 Third-party services
The Services may integrate with or link to third-party services (such as payment, hosting, or analytics providers). We are not responsible for third-party services, and your use of them may be subject to their own terms.
8 Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9 Limitation of liability
To the fullest extent permitted by law, Gold Standard Web will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim arose.
10 Indemnification
You agree to indemnify and hold harmless Gold Standard Web and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Services, Your Content, or your violation of these Terms or applicable law.
11 Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Upon termination, the rights granted to you will end, though certain provisions (such as ownership, disclaimers, and limitation of liability) will survive.
12 Governing law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Wisconsin, unless applicable law provides otherwise.
13 Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Terms.
